California prosecutes drunk driving under two different criminal statutes. The most common charge for  DUI  is under  California Vehicle Code Section 23152(b) . This code section makes it a crime to operate a motor vehicle with a  Blood Alcohol Level (BAC) of .08 or above . The State only needs to prove that you were operating a motor vehicle with a BAC of .08 or above.
